1.TERMS AND CONDITIONS

The meimeij.it digital store is managed by Angelica Fashion srl with registered office in Via Democrito, 12A/13/14, Carpi (MO), Italy, Company Register of MO, C.F. and VAT number 03714800368, a company that deals with all the operations listed below related to online sales in Italy and in other countries belonging to the Eurozone of MeiMeiJ brand products such as, by way of example but not limited to: management of orders, the sale and delivery of products, the management of returns, the guarantees of conformity of the product/s with respect to the sales contract and what is declared therein pursuant to current legislation, payments and invoicing, hereinafter only “Angelica Fashion”.


2.GENERAL CONDITIONS OF SALE

These general conditions of sale have the function of defining the rights and obligations of the parties in the field of online sale of goods offered by the seller to the consumer.
The use of the distance selling process described in these general conditions of sale is reserved exclusively for consumers, meaning natural persons who act for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out pursuant to art. 3 Legislative Decree 206/2005 (hereinafter referred to as "Customer" or "Customers").
The system, which requires active intervention by the customer, was created in full compliance with the legislation on distance selling as provided for and governed by the Consumer Code Legislative Decree 206/2005 and subsequent amendments and additions.


3.FIELD OF APPLICATION

These general conditions of sale are applicable to all sales of MeiMeiJ products concluded remotely through the MEIMEIJ.IT website.
These general conditions of distance selling must be carefully examined by the Customer before completing the procedure for purchasing the Products.
Every order placed for a Product in the online shop of the website www.meimeij.it presupposes consultation and acceptance first of all of these general conditions of sale as well as the payment conditions illustrated below.
The validation confirmation of the purchase order implies full acceptance of these conditions.
The Customer, with the acceptance of the purchase order on the website www.meimeij.it, also acknowledges that Angelica Fashion does not consider itself bound by general conditions of sale and/or payment other than the present ones, unless previously agreed in writing with the customer himself.
The general conditions of sale described there in are to be considered applicable and in force until they are published on the MEIMEIJ.IT website.
Future and any changes thereof will be published on the site and will be applied exclusively to orders placed starting from the day following their publication.


4.SELLER IDENTIFICATION

Angelica Fashion srl with registered office in Via Democrito, 12A/13/14, Carpi (MO), Italy Company Register of MO, C.F. and P. IVA 03714800368, online distribution company of MeiMeiJ branded products for the Italian market and for the market of countries belonging to the Eurozone.


5.OWNER OF THE RIGHT TO USE THE MEIMEIJ.IT DOMAIN

6. INFORMATION RELATING TO THE PRODUCT

On the MEIMEIJ.IT site, only products bearing the MeiMeiJ registered trademark are offered for sale. Angelica Fashion does not sell used, irregular or inferior products to the corresponding standards offered on the market.
The essential characteristics of the products are presented on the MEIMEIJ.IT website within each product sheet.
However, the images and colors of the products offered for sale on MEIMEIJ.IT may not correspond to the real ones due to the Internet browser and monitor used.
All products have an identification tag.
The Customer must not remove the aforementioned identification tag from the purchased product in the event that he intends to exercise the right of withdrawal, which can be exercised within the terms of art. 52 of Legislative Decree 206/2005 (Consumer Code).
Otherwise, Angelica Fashion has the right not to accept the return of products that do not have the relative tag or that have been altered or tampered with in their essential and qualitative characteristics or that have been damaged.


7.PRODUCT ORDER

The order can be made through the MEIMEIJ.IT website by following the steps and instructions specified on the site itself.
Upon successful conclusion of this process, Angelica Fashion will immediately notify the receipt of the order, reserving the right to perform a standard pre-authorization check on the Customer's payment card in order to ensure that there are sufficient funds to complete the transaction.
The order will be accepted once Angelica Fashion has received confirmation of the successful payment for the purchase of the Product.
Angelica Fashion also reserves the right to communicate, within 10 days following receipt of the purchase order, the possible impossibility of fulfilling the order itself, which will be followed by the immediate cancellation of the order and the simultaneous release of the entire amount reserved for payment, including shipping costs.
This circumstance may occur in the event that goods have run out or if the order does not correspond to normal consumption needs (this to be assessed, by way of example and not exhaustively, in relation to the number of products purchased within a single order , in the event of multiple orders relating to the same product, etc.) or due to force majeure.


8. PAYMENT

Each payment by the Customer can be made exclusively by credit cards indicated on the MEIMEIJ.IT website or with the PayPal payment method.
The total amount of the order is committed to the customer's credit card or PayPal account at the time the order is forwarded to Angelica Fashion, with acceptance of the same by the latter in accordance with the provisions of art. 7 of these general conditions of sale.
For payment purposes, the Customer must: - in case of payment by credit card, confirm the data of the holder of the credit card used for the purchase through the MEIMEIJ.IT website; then communicate on the site itself the 6-digit number and the expiry date, as well as the relative security code, - in case of payment by PayPal, enter the access details in the appropriate space of the PayPal page to which it will be sent automatically, to then complete the payment in the manner indicated by the service provider. The conclusion of the order procedure will be considered to have effectively taken place following the completion of the payment transactions, once the Customer will be redirected to the page of the MEIMEIJ.IT website bearing the confirmation of acceptance of the order.
If you buy with Scalapay, you receive your order immediately and pay in 3 installments.
You acknowledge that the installments will be transferred to Incremento SPV S.r.l., related parties and their assignees, and that you authorize this transfer.


9. PRODUCT PRICE

The price of the product published on the site refers to a single item, expressed in Euros and inclusive of VAT.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process, before making the payment and remain the responsibility of the Customer.
In compliance with the provisions of art. 53 of Legislative Decree 206/2005, the Customer receives, upon acceptance of his order in the manner set out in art. 7 of these conditions of sale, the written confirmation containing information about the products ordered, the amount paid, the details of the price of each product, the shipping costs, as well as the existence of the right of withdrawal and information on the services of assistance and on the guarantees of conformity of the product/s in accordance with current legislation.


10. DELIVERY

Angelica Fashion delivers throughout the Italian territory through the GLS courier and in the other countries belonging to the Eurozone through the DHL courier (costs charged to the customer €18).
The purchased product, together with the invoice, will be delivered by courier to the address specified by the Customer when ordering online.


10.1 DELIVERY IN ITALY

In the event of unavailability of the recipient, or of another person authorized to receive the shipment at the time of the first delivery attempt, the express courier will issue a paper notice containing details about the delivery attempt made, the codes and contact details that allow for agreement with the courier himself an appointment for the next delivery.
If the courier does not receive different instructions from the Customer, he will make a second delivery attempt which, if ineffective, will result in the shipment being placed in storage at the GLS courier branch closest to the address indicated by the Customer, for the following 10 days.
Starting from the date of storage, the Customer can go to the aforementioned depositary branch of the product/s with an identity document and proceed with the collection. In case of non-collection of the product/s by the Customer within the 10 days mentioned above, the order will be returned to Angelica Fashion, with simultaneous reimbursement of the relative cost of the product, net of shipping costs.
In the event that the delivery of the product/s to the Customer does not take place within 5 working days following the shipping date, as simultaneously communicated to the Customer by Angelica Fashion, and the impossibility of tracing the place where the goods are found via the online system which will be made available to the Customer, the latter must notify Angelica Fashion of the non-delivery of the product/s, via the "Contact" page within the Service area Customers of the MEIMEIJ.IT site.
Angelica Fashion undertakes to guarantee a new shipment of the lost product/s within 48 (forty-eight) hours following the notification, without prejudice to the unavailability of the same or force majeure, in which case the cancellation of the order will follow. order and the simultaneous return of the amount reserved for payment.


10.2 DELIVERY ABROAD (EUROZONE COUNTRIES)

In the event of unavailability of the recipient or other person authorized to receive the shipment at the time of the first delivery attempt, the courier will, in the event of an access point of the DHL Courier present within a radius of 5 km from the Customer's address, deposit the product/s where they will remain in storage for the following 10 days, subject to the release of a paper notice containing the details of the delivery attempt made, the codes and contact details of the depository access point.
Within this period, the Customer, provided with an identification document, can proceed with the collection of the product/s or, alternatively, request delivery to the address from the same communication.
In the event of non-collection within the above 10 days, the order will be returned to Angelica Fashion, with the simultaneous reimbursement of the cost of the product, net of shipping costs.
If within 5 km of the Customer's address there is no DHL Courier access point, the latter will issue a paper notice containing details of the delivery attempt made, the codes and contact details that allow the Customer to agree with the courier an appointment for the next delivery.
This first delivery attempt will be followed by two more with the same methods (paper notice and the possibility of agreeing an appointment with the courier for delivery).
In case of unavailability of the recipient or person authorized to receive the shipment at the time of the third and last delivery attempt, the courier will issue a paper notice communicating the return of the order to Angelica Fashion.
Reimbursement will follow in favor of the Customer of the cost of the product, net of shipping costs.
In the event that the delivery of the product/s to the Customer does not take place within 5 working days following the shipping date, as simultaneously communicated to the Customer by Angelica Fashion, and the impossibility of tracing the place where the goods are found via the online system which will be made available to the Customer, the latter must notify Angelica Fashion of the non-delivery of the product/s, via the "Contact" page within the Service area Customers of the MEIMEIJ.IT site.

11. RIGHT OF WITHDRAWAL AND RETURN

In accordance with the legal provisions in force and in particular with the provisions of art. 52 of Legislative Decree 206/2005, the Customer has the right to withdraw from the purchase within the term of 14 calendar days starting from the date of receipt of the product/s; the cost of the order will then be refunded, net of the shipping costs foreseen for the delivery.
Regardless of the withdrawal method chosen by the Customer, the returned Product must be returned intact and unused, together with the original packaging and any accessories, in the same condition in which it was received, no later than 14 calendar days from the day on which it was the withdrawal from the purchase has been communicated.
The Customer must especially ensure that: - the item has not been used or has suffered damage during the trial; - the item has not been soiled or washed; - the item retains all the original pendants, tags and finishes; - the article has not undergone any changes of any kind. In the event that the return does not meet the conditions listed above, or the products returned by the Customer are damaged, incomplete, deteriorated and/or dirty, they will not be refunded and will be returned to the Customer who will bear the courier costs for the return.
The Customer will be informed by e-mail of the acceptance or refusal of the return.


11.1 RETURNS ON E-COMMERCE

The Customer who intends to exercise this right, must access his account, in the appropriate section relating to orders and fill in the appropriate return form by accessing the site's order history.
In this form, the Customer must indicate: - personal details; - details of the order and reason for the return among those indicated.
Furthermore, it will be necessary to send an email to info@meimeij.it containing the information included in the return request in order to book the collection with the courier and, for foreign orders, send the DHL label.
For returns in Italy, the product must be delivered to the GLS Courier who will go to the Customer's premises within 24 hours of the request.
For returns in other countries belonging to the Eurozone, the Customer must affix the return label sent following the return request and return it to the DHL Courier who will go to the Customer's premises within 5 days of the request.
The procedures for returning to the Courier are specified on the site.
The costs of returning the products by courier are charged to the customer for orders received from countries belonging to the Eurozone.


12. REFUND

In the event of the right of withdrawal exercised in the manner, terms and in compliance with the conditions set forth in art. 11. of these general conditions of sale.
In the event of a refund of the amount paid, the operators or the sales manager must first ascertain that the product has not been used or damaged (in this regard, we invite you to read the conditions of integrity of returned items in article 11).
The Customer will then receive an email confirming the successful outcome of the return; Angelica Fashion will credit the amount corresponding to the amount paid for the returned Product using the payment method selected at the time of purchase, within 21 calendar work days of receipt of the returned goods.
In the event that the refunded amount is incorrect, the Customer must contact Customer Service for a quick resolution of the problem.


13. ITEMS NOT ORDERED, DAMAGED, OR NOT IN COMPLIANCE WITH ORDER

We wish to inform Customers that MEIMEIJ.IT subjects its garments and the materials with which they are made to strict quality controls, guaranteeing their marketing in perfect conditions.
In addition, for greater protection of those who make remote purchases, every single item shipped by MEIMEIJ.IT is checked before shipment.
In the event that the color of the item received does not respond to what was expected at the time of the order, the Customer can return it within the terms of the return period (14 calendar days from delivery of the order to communicate the request for withdrawal and 14 subsequent calendar days to this communication to deliver the return to the courier or send the return to the chosen MeiMeiJ sales point), following the return procedure referred to in articles 11, 11.1 and 11.2.
If the Product is damaged, or was not ordered by the Customer, it can be returned immediately through the procedures indicated in articles 11.1. and 11.2 specifying the reason for the request.
The return shipping costs will be fully borne by Angelica Fashion.
If there is evidence that the package upon delivery has been tampered with or damaged and that, consequently, the product has been damaged during transport, the Customer must refuse the package. Angelica Fashion will reimburse the sold product that has been damaged during shipment by the courier, provided that the Customer has communicated the damage in writing to the email address info@meimeij.it within 48 (forty eight) hours following the refusal of the package delivered to him, pursuant to art. 10 above.
If even just one of the above conditions is not respected, Angelica Fashion will not credit the amount paid, nor will it replace the product which, in this case, will be immediately made available to the Customer for collection at his expense. Angelica Fashion, in this case, will communicate the refusal of the return via email, indicating the place where to make the collection.
Lastly, we inform you that requests for sartorial modifications to the purchased items will not be granted under any circumstances.
Likewise Angelica Fashion will not reimburse the costs incurred by the Customer to autonomously make adjustments and/or tailoring changes to the purchased items which, therefore, will remain the sole responsibility of the Customer.
In cases of faulty items, the Customer is always invited to contact Customer Service as soon as possible and in any case within the product's return period, for any prior agreements of the case.


14. COMPLIANCE - WARRANTY

As regards the guarantees of conformity of the product purchased, the legal guarantees established by law are also applicable to the sale of Angelica Fashion products regulated by these general conditions.
We therefore refer to articles 129, 130 and 132 of the Consumer Code relating to the rights of customers against Angelica Fashion in the event of non-compliance of the products delivered and the methods of their exercise.


15. COMPLAINTS - COMMUNICATIONS - INFORMATION

For any information or complaint, or for any communication relating to the general conditions of mail order sales, orders and/or MeiMeiJ products, the Customer may contact Customer Service via the e-mail address info@meimeij.it within the section Customer Service on the MEIMEIJ.IT website.
The Customer can contact Customer Service free of charge by email by completing the appropriate form.
It should be noted that, where the Customer decides to use any other channel or form of communication (for example: ordinary mail, fax, calls to a paid telephone number in any case attributable to Angelica Fashion) with respect to those described above, Angelica Fashion will not will in no case be required to reimburse any related expenses incurred by the Customer.


16. MAJOR FORCE

The execution of the services by the Angelica Fashion company may be suspended in the event of the occurrence of a fortuitous case or force majeure, including natural events, which prevents or delays the execution.
Are considered as such, for example, but without limitation, war, riots, insurrections, strikes and supply problems of the Angelica Fashion company attributable to third party suppliers.
The Angelica Fashion company will inform the Customer of the occurrence of the fortuitous event or force majeure within 7 (seven) days from the occurrence of the same.
In the event that the suspension of the service should be extended for a period exceeding 15 days, the Customer will have the option of canceling the order placed and will be reimbursed for the amounts already paid.


17. APPLICABLE LAW AND JURISDICTION

These general conditions of sale are governed by Italian law.
In the event of disputes arising from the interpretation, validity, and/or execution of these general conditions of sale, the mandatory territorial jurisdiction will be that of the judge of the place of residence or domicile of the consumer.
